Underage DUI Laws & Penalties in Colorado
In Colorado, it is illegal for individuals under the age of 21 to consume or possess alcohol. The state has a zero-tolerance policy for underage drinking and driving, imposing strict penalties for those who violate these laws.
If an underage driver has a blood alcohol content (BAC) between .02 and .05 percent, they can be charged with underage drinking and driving (UDD), punishable by a fine of up to $100, driver's license suspension for 3 months, alcohol education programs, and community service.
If an underage driver has a BAC between more than .05 percent but less than .08 percent, they can be charged with driving while ability impaired (DWAI), which carries a jail term of up to 180 days and a maximum fine of $500.
If an underage driver has a BAC of at least .08 percent, they will be charged with a standard DUI as if they were an adult.
